Service Terms and Conditions for Rubbish Collection Crystal Palace

These Terms and Conditions set out the basis on which rubbish collection and related waste removal services are provided by Rubbish Collection Crystal Palace to residential and commercial customers. By making a booking, confirming a quotation or allowing our operatives to begin work, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, unless the context requires otherwise:

Company means Rubbish Collection Crystal Palace, the provider of waste and rubbish clearance services.

Customer means any individual, business, landlord, managing agent, or organisation requesting or receiving services from the Company.

Services means rubbish collection, waste removal, bulky waste collection, garden waste clearance, household rubbish removal, commercial waste clearance and any related services supplied by the Company.

Site means the premises or location where the Services are to be carried out.

Waste means any materials, items or substances presented for collection and removal in connection with the Services.

2. Service Area and Availability

The Company primarily operates in and around the Crystal Palace area and nearby districts. Provision of Services is subject to availability of collection slots, vehicle capacity and staffing levels. The Company reserves the right to refuse or reschedule a booking if it is outside the practical service area or cannot be safely serviced.

The Company does not guarantee availability of specific dates or times until a booking has been confirmed in writing, by email, or verbally with a confirmed reference.

3. Booking Process

3.1 Customers may request a quotation for rubbish collection or waste clearance by telephone, email, online form, or other communication method accepted by the Company.

3.2 Quotations are based on the information provided by the Customer, including description, estimated volume, type and location of waste, access conditions and any special requirements.

3.3 The Company may adjust the quotation on arrival at the Site if the actual waste volume, weight, type or access conditions differ from the information originally provided. Any adjustment will be discussed with the Customer before work begins.

3.4 A booking is deemed confirmed when the Customer accepts the quotation and receives confirmation from the Company, or when the Company attends the Site and the Customer allows work to commence.

3.5 Customers must ensure that an authorised person is present at the Site at the agreed time to grant access, confirm the waste to be removed and approve any necessary changes to the quotation.

4. Customer Responsibilities

4.1 The Customer must provide accurate information regarding the type, volume and condition of waste, site access, parking arrangements, and any risks or hazards present.

4.2 The Customer is responsible for obtaining any necessary permissions, permits, or consents required for the Company to access the Site, including parking permissions, entry codes, building management approvals or local authority consents.

4.3 The Customer must ensure that access to the Site is safe, unobstructed and compliant with health and safety requirements. The Company may refuse to perform the Services if access is unsafe or significantly restricted.

4.4 The Customer must segregate prohibited or hazardous items from general rubbish, clearly identify any special wastes, and follow any instructions given by the Company regarding safe presentation of waste.

5. Scope of Services

5.1 The Services include loading of agreed waste into the Company vehicle, transportation and lawful disposal or recycling at licensed facilities in accordance with applicable waste management regulations.

5.2 Unless expressly agreed in writing, the Services do not include cleaning, sweeping of large areas, removal of fixtures or fittings, disconnection of appliances, demolition, or any works requiring specialist tools or qualifications.

5.3 The Company reserves the right to refuse to remove any waste that it reasonably considers to be hazardous, unlawful to transport, excessively heavy or unsafe for manual handling, or not as described at the time of booking.

6. Prohibited and Restricted Waste

6.1 The Customer must not present for collection any waste that is classed as hazardous or controlled unless previously declared and specifically agreed in writing. Examples of such waste include but are not limited to:

Asbestos or suspected asbestos containing materials.

Chemicals, solvents, paints, oils or fuels.

Clinical or medical waste, sharps or biological materials.

Pressurised containers, gas bottles or explosives.

Large quantities of tyres or electrical items beyond normal household volumes unless agreed.

6.2 If prohibited or restricted waste is discovered during collection, the Company may refuse to remove these items, charge a supplementary fee for their handling, or terminate the Service. The Customer may be liable for any additional disposal or regulatory costs arising from undeclared hazardous wastes.

7. Pricing and Quotations

7.1 Quotations are usually based on estimated volume, weight, type of waste, labour time, and any access factors such as stairs, distance to vehicle or restricted parking.

7.2 Unless otherwise stated, prices quoted are exclusive of any additional charges such as parking fees, congestion or emission zone charges, tolls, or special disposal costs for specific waste streams.

7.3 If on arrival the actual waste is significantly different from that described at the time of quotation, the Company may revise the price. The Customer will be informed of any price change before the work is carried out and may choose to accept or decline the revised quotation.

7.4 All prices are subject to applicable taxes and charges as required by UK law.

8. Payments

8.1 Payment is due on completion of the Service unless otherwise agreed in writing in advance. The Company may require a deposit or full payment prior to attendance for larger or commercial bookings.

8.2 The Company accepts payment methods communicated at the time of booking, which may include cash, card payment, bank transfer or other agreed methods.

8.3 For business or account customers granted credit terms, invoices are payable by the due date stated on the invoice. If no date is specified, payment is due within 14 days of the invoice date.

8.4 The Company reserves the right to charge interest, administration fees and reasonable recovery costs for late payments in accordance with applicable UK legislation.

9. Cancellations and Rescheduling

9.1 The Customer may cancel or reschedule a booking by giving the Company reasonable notice prior to the agreed arrival time.

9.2 The Company may charge a cancellation fee if the Customer cancels less than 24 hours before the agreed time, if the Company has incurred costs such as travel, staffing or permit fees, or if the Company arrives at the Site and is unable to gain access through no fault of its own.

9.3 The Company reserves the right to cancel or reschedule a booking due to events beyond its reasonable control, including but not limited to severe weather, vehicle breakdown, road closures, staff sickness or safety concerns. In such cases, the Company will seek to offer an alternative date and time, but will not be liable for any indirect or consequential losses arising from the cancellation.

10. Access, Parking and Waiting Time

10.1 The Customer is responsible for ensuring adequate parking arrangements for the Company vehicle at or near the Site. Any parking charges, fines or penalties incurred as a direct result of insufficient or incorrect information provided by the Customer may be passed on to the Customer.

10.2 If operatives are kept waiting beyond a reasonable period due to lack of access, site readiness or absence of an authorised representative, the Company may charge a waiting time fee or, at its discretion, cancel the booking and apply a call-out or cancellation charge.

11. Damage and Liability

11.1 The Company will exercise reasonable care and skill in providing the Services. However, minor scuffs or marks may occur where large or heavy items are removed from confined spaces. The Customer should take reasonable steps to protect floors, walls, doors and fixtures if this is a concern.

11.2 The Company shall not be liable for any pre-existing damage to property or items, or for damage resulting from latent defects, unsuitable construction, or unsafe conditions at the Site.

11.3 The Company’s total liability for any loss or damage arising from the Services, whether in contract, tort or otherwise, shall be limited to the total price paid or payable for the relevant Service, except where such limitation is not permitted under UK law.

11.4 Nothing in these Terms and Conditions limits or excludes the Company’s liability for death or personal injury caused by its negligence, fraud, or any other liability that cannot be limited or excluded by law.

12. Waste Transfer and Compliance

12.1 The Company operates in accordance with relevant UK waste management legislation and holds appropriate registrations or licences for carrying controlled waste, where required.

12.2 On completion of a collection, the Company assumes responsibility for the Waste and will transport it for treatment, recycling or disposal at licensed facilities in compliance with applicable regulations.

12.3 Where legally required, the Company will issue a waste transfer note or other documentation to record the transfer of waste from the Customer to the Company.

13. Environmental Practices

13.1 The Company aims to minimise the amount of waste sent to landfill by prioritising reuse, recycling and recovery routes where practical and economically viable.

13.2 The Company does not guarantee that any particular item will be recycled or reused, but will handle waste streams in line with its environmental practices and regulatory obligations.

14. Complaints and Disputes

14.1 If the Customer is dissatisfied with any aspect of the Services, they should notify the Company as soon as possible, providing a clear description of the issue and any supporting information.

14.2 The Company will investigate complaints promptly and seek to resolve them by repair, re-performance of services, partial refund, or other appropriate remedy where justified.

14.3 If a dispute cannot be resolved directly, either party may pursue resolution through applicable legal channels or alternative dispute resolution processes where available.

15. Data Protection and Privacy

15.1 The Company will collect and process personal data provided by the Customer only to the extent necessary to manage bookings, deliver the Services, process payments and meet legal obligations.

15.2 The Company will take reasonable steps to safeguard personal information and will not sell or share customer data with third parties for marketing purposes without consent, except as required by law or for the proper performance of the Services.

16. Variations to Terms

16.1 The Company reserves the right to amend these Terms and Conditions from time to time. Updated terms will apply to new bookings from the date of publication or notification.

16.2 The version of the Terms and Conditions in force at the time of booking will apply to that booking, unless a variation is agreed in writing between the Company and the Customer.

17. Severability

17.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.

18. Governing Law and Jurisdiction

18.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales.

18.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or relating to these Terms and Conditions or the provision of rubbish collection and waste removal services.

By proceeding with a booking or accepting Services from Rubbish Collection Crystal Palace, the Customer confirms that they have read, understood and agree to be bound by these Terms and Conditions.
